We are at David Walleys and have just been hit with a request for special assessment to of $964?. We just paid our year our yearly maintenance of $699 per year for our annual 2 bedroom:. Our maintenace, like everyone elses is supposed to pay for the upkeep & taxes/. The $964 per unit times 52 weeks per year is trying to get $50,128 per unit in special assessments/. When we bought our time share we were told that they could only raise our maintenance a small percentage per year,. This is rediculous and the only way to vote against it is to attend the meeting over 300 miles away!. If we vote our proxy it will be used to vote with the majority and who knows who will be at the meeting.. I too would be interested in a class action lawsuit?. my email address is 2cd0c96

Legal action and getting owners together and communicating seems to be the only answer at this point. I was there this weekend, and there is NO ONE from Celebrity representing at the resort any longer - they have disappeared because they can't take the pressue.  

 

I als find it incredibly frustrating that rentals from outside consumers have been stopped, owners that are paying cannot purchase extra weeks, those of us paying dues have not been offered a chance to pay dues in exchange for extra weeks for those not paying dues - two ways that seem easy to bring money in in the short run. I actually saw two couples wanting to pay money to stay at the resort, and they were turned away. 

 

The restaurant and deli were closed as of Saturday night - they were not part of our ownership, but were owned by Celebrity - I find that confusing but I am sure it was in the deed paperwork and I just didn't "get it". Those folks still working there seem to be trying very hard to provide good service and manage the high emotion of guests, but they can only do so much. 

 

If the spa is only committed to being open until the end of 2010, what would our timeshare be worth without it - not much! I might have voted for the special assessment at one point, but after going there I am glad I didn't. Throwing good money after bad would not have helped and just like any public company I have worked for, the company needs to learn how to manage to the actual budget and that means cuts. I think they are doing the right thing to close some buildings and scale down until things can get figured out.  

 

They also need to go after those not paying much more aggeressively. I understand if you lose your job and you can't pay, but I am sure there are many that can afford to pay but just don't want to and collection efforts need to be stepped up.  

 

I need to read my deed again, but can anyone that is more savvy tell me what the end result will be for owners if things fall apart - do we lose the investment entirely? Does the property sell for rock bottom, and we have to sue to get any money back?

We are some of the original owners of the Aurora Bldg. and are more than displeased with what has happened to our property. 

I would rather pay for legal services than pay Celebrity tribute. 

 

That includes suing the Board if they have broken their fiducary responsibilities.

I want to know if it is legal in Nevada to hold an election and not send out a ballot to vote. ????? 

It should be illegal that only those that show up can vote and it should be illegal to not sent a proxy that the owner can designate someone other than the board. 

 

We did not get any of those options.

Special Assessment to me equals nothing more that inept management. I have been watching the Aurora building slowly falling apart. Elevators are no longer being inspected, cement deteriorate on second and third floor walkways. Stairwells literally falling apart. And, when I asked to speak to someone about it during my stay, I get the brush off by the folks in the "Sales" building. Last year the pool area looked like an earthquake had hit it, broke and cracked cement everywhere. The place is being ran into the ground. And now they want almost another grand? At $700 a year for maintenance fee, that equates to a $100 a day to stay in my timeshare. At $1,600 for my annual investment, that's $228 dollars a day. Come on folks... We're talking some high-dollar pricing for some low dollar rooms. I knew the second month I owned my Time share at David Walley's that I made a mistake. But I have stayed with the program for better part of a decade... If things don't change, David Walley's Resort is going to become a ghost town in its own right. Bodie II...

We'll need everyone's help to rectify this situation. Unfortunately, it is much like what happened at Hanalei Bay. Lucky for the owners there, they were able to wrestle back control of their resort from Celebrity.

I agree with the posts on this. I have sent the following to Celebrity...the only people you can contact. The so-called Board is not available to contact. Who voted for them anyway? 

Dear Celebrity Resorts 

My name is .... and I am an owner at the Carson Valley property. My owner # is ...... I have reviewed the Special Assessment FAQs posted on the website and several unanswered questions.  

It is very clear that the current budget is not adequate to cover operating costs, at least according to the FAQs. My questions are 

1. How did it get this way? 

2. Did Quintus mis-manage or steal money? 

3. What was the fiduciary responsibility of the David Walley's Property Owners Assn regarding oversite of the previous management? Did they do their job, or were they negligent?  

4. If there was malfeasance or negligence, is there any liability or accountability for this mis-management of our property owners monies? Is or should the Nevada Attorney General's office be informed or involved? 

Basically we are being presented with a statement that says "we have mismanaged this property, in your name, to the point that we are going broke. You now have to pay up or lose your investment." This is not a good message to people, who in tight economic times, are having their own financial struggles. A $1000 Special Assessment is not a small sum to me, and I don't appreciate the lack of information and poor communication from my supposed representatives. I would come to the meeting but do not live proximate enough to make that feasible, so my only option is to write this letter and hope someone bothers to answer me honestly. 

If I have to pay a Special Assessment, what assurance do I have that things will be better managed and that communication will be more forthcoming or transparent? I am not even sure how these people got elected to the Board to begin with. I wasn't asked to vote. If the only votes that get taken are in person, then what we have is a little club running things, and no one else can find out what's going on. Seems suspect to me at best.

I too am a Walley's resort owner. I am not only concerned, but am at odds as to how they could ask for a special assessment without any detail.

Surprise, surprise, our story is identicaly to the two I see above (we too own at Walley's), and like the others, we too have been searching on the internet and see that Celebrity Resorts M.O. is rising maintenance fees and "special assessments" (which seem to never stop, by the way.) We too will be looking into what we can do and if we figure out some response to this, we will post.
